The terms and conditions explain the nature and scope of “(Flourrish) Flourrish – Salon and Makeover Studio” herein referred to as “flourrish” (as owner and management for the Service) and Users/Customers of FLOURRISH (Flourrish). The terms and conditions cover service usage, rules of usage, limitations, and exclusions on the liability of FLOURRISH (Flourrish).
PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THIS IS A LEGAL AGREEMENT BETWEEN salon.salon.flourrish.in (FLOURRISH) AND YOU WHICH GOVERNS YOUR USE OF SERVICES. YOUR USE OF SERVICES CONSTITUTES YOUR ACCEPTANCE OF AND AGREEMENT TO ALL OF THE TERMS AND CONDITIONS IN THESE TERMS OF SERVICE AND YOUR REPRESENTATION THAT YOU ARE 18 YEARS OF AGE OR OLDER. IF YOU OBJECT TO ANYTHING IN THESE TERMS OF SERVICE, YOU ARE NOT PERMITTED TO USE THE SERVICES.
These services are protected by copyright laws & treaties, as well as other intellectual property laws and treaties. Unauthorized reproduction or distribution of the Services, or any portion of them, may result in service civil and criminal penalties and will be prosecuted to the maximum extent possible under the law. The services are licensed, not sold.
- DEFINITIONS
In these terms and conditions, unless the context specifies otherwise:
1 (a) – “Flourrish Salon and Makeover Studio” shall mean FLOURRISH is a proprietary firm and has its registered office at A1, Royal Enclave, Injambakkam, Opp: ECR Food Street, East Coast Road, Chennai – 600115 and such expression shall, unless it is repugnant to the subject or context thereof, include its successors, assigns, representatives and transferees.
1 (b) -“FLOURRISH – Salon and Makeover Studio” means a program designed for its customers by Salon.flourrish.in which the customers enjoy beauty (Salon) services in the comfort of their respective scheduled times or at their homes.
1 (c) – “Flourrish” Customer/User” means a Flourrish customer, who is registered as a Customer/user of Flourrish holding a user ID on the Website of Flourrish (Salon.flourrish.in). Registration to the program is governed by these rules set by Flourrish for this program which are subject to change at any time.
1 (d) – “Program” means the service, operated and managed by Flourrish through its Professional Beauticians at our physical salon and also offering facilities or arrangements of Salon at your doorstep (Home) to its registered users/customers.
1 (e) – “Working Days” means the period from Monday to Sunday. Timings are from 09.00 AM to 09:00 PM only.
- GENERAL CONDITIONS
2 (a) – The Flourrish Users/customers agree that by using the website at salon.flourrish.in post login, the customer he/she is deemed to have read and understood these terms and conditions of the Program and confirms that he/she is bound by these terms and conditions and any changes to it from time to time and such other terms as specified from Flourrish from time to time. You authorize us to call/SMS/email/WhatsApp you in the future for products and promotions
2 (b) – Registration into Flourrish Program/Service is voluntary, open to all-natural persons above the age of 18 (except only where the Partner Program is otherwise) with a correct mailing address in India.
2 (c) – Flourrish provides service for Men, Women, and Kids only.
2 (d) – Flourrish doesn’t do cross-gender service. i.e Only Male to Male and Female to Female services when booked services at home.
2 (e) – The entire responsibility is on the customer booking the service and the residence owner to ensure that the female beauticians visiting their premises are professionally respected and their personal, physical or emotional safety is not breached under any circumstances. Any deliberate abuse of the beautician’s personal and emotional safety will result in the criminal prosecution of the customer under the jurisdiction of the local court.
2 (f) – Flourrish reserves the right to modify these Terms and Conditions & such changes shall be deemed effective immediately upon posting of the modified Terms and Conditions on salon.flourrish.in Users’ continued usage of Flourrish Website salon.flourrish.in holding of the Flourrish Account following the posting of changes on salon.flourrish.in will indicate their acceptance of changes.
2 (g) – Flourrish Account is valid for lifetime post registration unless terminated in accordance with these terms and conditions.
2 (h) – Flourrish customers will be personally liable for any and all costs, taxes, charges, claims or liabilities of whatever nature arising from the provision or availability of benefits, facilities, or arrangements provided or made available to the customers, by Flourrish.
2 (i) – The Flourrish account of the customers at all times remains the property of Flourrish, which reserves the right at any time in its absolute discretion and without giving notice to such users to deactivate their account.
2 (j) – Flourrish shall not be liable for any loss or damage, whether direct or indirect, resulting from the service provider or the product sold by the service provider.
2 (k) – The Program on the Flourrish Website may be modified at the sole discretion of Flourrish from time to time without intimation to the Flourrish customers/users.
2 (l) – If there are any changes in the contact details (mobile number/ email id/ address) of a Flourrish customer/users from what has been registered with Flourrish, the users must update the respective contact details immediately either through the website, or call to avoid any misuse of customer’s Flourrish Account. Flourrish shall not be liable for any loss or other relevant damages incurred by the customers/ users, if necessary details are not updated with Flourrish on time.
2 (m) – All Flourrish dispute complaints older than 15 Working Days from the date of the service availed will not be entertained. The Flourrish customer/Users must provide proof of service availed as required to register any dispute.
2 (n) – Each provision of the Terms is independent of the other. If any provision of the Terms is found void and unenforceable, it will not affect the validity of the remaining provisions of the Terms, which shall remain valid and enforceable.
2 (o) – End-moment service changes or cancellations might incur conveyance charges up to Rs. 500.
2 (p) – Flourrish has the right to change your Stylist at the end moment. This might happen due to any emergency or health issue with the already assigned Stylist
2 (q) – In the Case of Online Payment or Pre-Payment, the Full amount will be refunded (excluding the transaction charge of as applicable) if the cancellation is done before 3 hours of the scheduled service. No refund will be given in case of cancellation within 3 hours of the scheduled service.
2 (r) – Flourrish access your Google accounts which auto-fills your email/phone number in the Sign-Up and Login forms. This information is used for Login and Sign Up and calling by Flourrish Customer Care and Stylist only.
- WARRANTIES / GUARANTEE
3 (a) – All warranties and guarantees on the Flourrish services are the sole responsibility of the Service Provider/Seller(s) (except in some cases where the warranty or guarantee may be from the manufacturer(s)) providing the Beautician Service. Flourrish shall not be liable or responsible for any defect or deficiency in the products used and service provided by the beauticians whatsoever. All guarantees and warranties on the Flourrish shall be transferred as is from the manufacturer or the Service provider/Seller(s).
3 (b) – Flourrish Users must contact the respective Seller(s) / Manufacturer (in case of manufacturer warranty) in the event of any defect or deficiency in the Service or product. In such an event, Flourrish will purely act as a complaint routing agent. Flourrish will not be liable or responsible for the products and services offered through the Partner Beauticians or other service providers and Flourrish gives no warranty or representation either express or implied with respect to the type, quality, or fitness of goods acquired or their suitability for any purpose provided by the Supplier under this Program, whatsoever.
- INDEMNIFICATION
4 (a) – Customer/user agrees to indemnify, defend and hold Flourrish, its affiliates, successors, assigns and licensors, franchisees or sub-franchisees, any of their respective officers, directors, employees, agents, vendors, licensors, representatives, advertisers, service providers and suppliers harmless from and against any and all claims, actions, losses, expenses, damages and costs (including reasonable attorneys’ fees), resulting from any breach or violation of Terms by you, or due to your activities related to the Flourrish Service, whether by use of User Account or otherwise.
- APPLICABLE LAWS
5 (a) – These Terms contain the entire understanding and agreement between User and Flourrish & supersedes any and all prior or inconsistent understandings relating to Flourrish Service and your use of Flourrish Service. Terms cannot be changed or terminated orally. Any provision which must survive in order to allow us to enforce its meaning shall survive the termination of Terms. Terms and your use of Flourrish Service are governed by, construed, and enforced in accordance with the laws of India applicable to contracts made, executed, and wholly performed on the Flourrish Service and for the purposes of any and all legal or equitable actions, you specifically agree and submit to the exclusive jurisdiction and venue of the local Courts of your City and State in India and you will not object to such jurisdiction or venue on the grounds of lack of personal jurisdiction or otherwise.
- DISCLAIMER
6 (a) – Flourrish is a connector between the service provider and the customer. Though there is a thorough background check and screening done on our partner beauticians.
6 (b) – Flourrish does not take any responsibility with regards to the behavior, actions or conduct of the beautician towards the customer. The customer/user should take care of their belongings and valuables during the visit of the beauticians. Flourrish will not be responsible for any loss or damage of valuables of Customers during or post visits of the beauticians booked through Flourrish.
6 (c) – You understand the Flourrish Service and agree to the fullest extent and their successors and assigns, or any of their affiliates or their respective officers, directors, employees, agents, licensors, representatives, operational service providers, advertisers or suppliers shall not be liable for any loss or damage, of any kind, direct or indirect, in connection with or arising from use of the Flourrish service or from this terms of use, including, but not limited to, compensatory, consequential, incidental, indirect, special or punitive damages.
6 (d) – Acceptance of booking amount is neither a commitment nor a guarantee by Flourrish to mandatorily provide a beautician for the services
6 (e) – Flourrish is neither responsible nor liable for ensuring the quality of the products and services provided by the beauticians. Any need for a legal arbitration or proceedings which arise out of the service or the purchase of the products from the beautician is to be settled between the customer and the service provider without our involvement.
